Division Rules
This is a listing of N.C. Administrative Code rule change activity within the Division of Services for the Blind, which come as a result of changes in program regulations. These rules must be revised in order to comply with program regulations and provide clarification of program procedures. The division is also required to complete the periodic review of existing rules processes, per G.S. 150B-21.3A. It has been determined that the rules have no fiscal impact, so no fiscal notes are required.
The North Carolina Register is issued twice a month by the North Carolina Office of Administrative Hearings (OAH). G.S. 150B requires some rules and notices to be published in the North Carolina Register. You can find the division's rules and notices that are put in the North Carolina Register on the OAH website.
Proposed Rule Changes
The rules are available for written public comment from March 2 – May 1, 2020. Public comments should be sent to Cynthia Speight, NC Division of Services for the Blind, 2601 MSC, Raleigh, NC 27699-2601; email dsbpubliccomment@dhhs.nc.gov.
Procedure for Subjecting a Proposed Rule to Legislative Review: If an objection is not resolved prior to the adoption of the rule, a person may also submit written objections to the Rules Review Commission. If the Rules Review Commission receives written and signed objections in accordance with G.S. 150B-21.3(b2) from 10 or more people clearly requesting review by the legislature, and the Rules Review Commission approves the rule, the rule will become effective as provided in G.S. 150B-21.3(b1). The commission will receive written objections until 5 p.m. on the day after the commission approves the rule. The commission will receive those objections by mail, delivery service, hand delivery or facsimile transmission.
